case. 1 5 Case shall mean the Debtor's above captioned Chapter

1 . 6 Claim shall mean a claim against the Debtor as
defined in Section 101 (4 ) of the Bankruptcy Code.
1.7 Coke Oven Property shall mean the parcel referred to
on the Debtor's Schedule A as the "Coal Basin Fee Coke Oven
Property. "
1.8 Court shall mean the United States District Court
for the District of Colorado in Bankruptcy or, if appropriate, the
United States District Court for the District of Colorado.
1.9 Creditor Representatives shall mean the individuals
performing the functions specified in Section 6.2 of the Plan.
1. 10 Creditors' Trust shall mean the trust established
pursuant to Section 6 .2 of the Plan.
1. 11 Creditors ' Trustee shall mean the trustee of_ the
Creditors' Trust.
1. 12 Debtor shall mean Mid-Continent Resources, Inc.
1. 13 DMG shall mean the Colorado Department of Natural
Resources, Division of Mineral Geology, formerly known as the
Colorado Mined Land Reclamation Division.
1. 14 Effective Date shall mean the later of (i) the
thirtieth day following the entry of a Final Order confirming the
Plan, or if such day is a Saturday, Sunday or holiday, the next
business day thereafter, or (ii) the first business day on which
the Debtor has funds sufficient to make the cash payments required
by Section 6. 1 of the Plan; in either event, no later than August
1, 1994 .
- - 1. 15 Environmental Account shall mean the account
established in Section 4 .4 of the Plan for purposes of funding the
Environmental Remediation.
1. 16 Environmental Remediation shall mean environmental
remediation which is required by applicable federal or state
statute, regulation, rule, or other doctrine of law or equity,
whether or not such claims represent claims for money damages,
injunctive relief, or for enforcement of other legal or equitable
rights, specifically excluding Class 5 reclamation claims, and-
specifically including such matters as removal of asbestos,
underground storage tanks, PCB-contaminated items, or other
hazardous substances, and monitoring and treatment of water
discharging from the mine, required with respect to any property
owned by the Debtor, including the Mine Site, the Carbondale
