The following narrative describes the scope of the <br /> project, as well as other pertinent information. The Division of Minerals and Geology(Division) <br /> requests a determination from the Army Corps regarding the type of permit, if any, needed in <br /> order that construction may begin in mid-September, 1998. <br /> To assist you in your review, I am enclosing preliminary blueprints of the channel topography, <br /> cross sections and a channel profile. An aerial photo with an overlay depicts the approximate <br /> location of the channel in relation to current topography. Please return the aerial photo at your <br /> convenience. I am also enclosing a copy of a paper presented by the designers of the channel. <br /> This paper contains information relative to the channel design parameters, and information <br /> pertinent to the Dutch Creek flow regime. <br /> The Coal Basin Mine was a permitted mine under the provisions of the Colorado Surface Coal <br /> Mining Reclamation Act (Act). Under the authority of the Federal Surface Mining Control and <br /> Reclamation Act (SMCRA) of 1977, the State of Colorado promulgated this coal mining <br /> regulatory statute. The mining operation was permitted under the provisions of the Act through <br /> the Division of Minerals and Geology. <br /> The Coal Basin Mine was in operation from about 1954 through about 1990. In the early 1990's <br /> operations were discontinued. Shortly thereafter, the operators of the mine filed for Chapter 11 <br /> I <br />
