Solicit additional contributions of matching funds as the project progresses if necessary <br /> D. THE COOPERATOR SHALL: <br /> 1. Assign a Project Manager to coordinate all phases of the Project. The Project Manager <br /> will be responsible for establishing Project goals, objectives, and tasks, development of <br /> construction specifications and oversight of construction. Project Manager will keep the <br /> Forest Service informed of project status, and act as the Principle Representative for the <br /> purposes of information dispersal and inter-agency coordination. . <br /> 2. Attempt to stabilize the Mine Bench Outslopes at Mine 1 East, Mine 1 Storage bench, <br /> Mine 3 East and, if funding allows, at the Mine 5 Fan at the Coal Basin Mine. <br /> Stabilization will be accomplished through revegetation processes to be conducted at <br /> each of the Outslopes. Revegetation process will likely include severe scarification of the <br /> Outslopes, incorporation of organic materials into the Outslope material, and distribution <br /> of seed, fertilizer and mulch. Seedling trees or shrubs may be planted in bands across <br /> one or more slopes. Natural sediment barriers consisting of shrub plantings may be <br /> established at the toe of one or more Outslopes, as slope and moisture conditions allow. <br /> Monitoring of the Project will be accomplished by indirectly measuring surficial slope <br /> stability by such techniques as quantitatively measuring vegetative cover at transect <br /> locations, measurement of gully activity at each Outslope and possibly by applying <br /> sediment generation models to the slopes. Maintenance, which will generally, consists of <br /> over-seeding and additional tree and shrub plant will be accomplished in years following <br /> the initial stabilization process, as funding allows. Fieldwork will be completed by <br /> November 1 of each year. <br /> 3. Provide a copy of the annual Coal Basin Watershed Non-Point Source Report to the <br /> Forest Service by March 15 of each year following fieldwork. <br /> 4. Perform all the required NEPA clearances (Cultural, Fish, and Wildlife) as needed and <br /> provide such documentation to the Forest Service for review. The Forest Service shall <br /> be responsible for the final decision documentation. <br /> 5. Minerals and Geology will contribute an estimated $50,000 in cash towards reclamation <br /> construction at the Mine Bench Outslopes. <br /> 6. Solicit additional contributions of matching funds as the project progresses if necessary. <br /> 7. Give the Forest Service or Comptroller General, through any authorized representative, <br /> access to and the right to examine all books, papers, or documents related to this <br /> instrument. <br /> 8. Bill the Forest Service for their prorated share of actual costs incurred to date, less <br /> program income, excluding any previous Forest Service payment(s) made on this <br /> instrument to the date of the invoice. <br /> 9. Pursuant to the Debt Collection Improvement Act of 1996, as amended by P.L. 104-134, <br /> furnish their tax identification number upon execution of this instrument. <br /> Page 2 of 6 <br />
