BASIC TERMS AND CONDITION—ALL FACILITIES(cont.) <br /> otherwise provided by the Division, the permittee shall have 30 days after such notification to both make the <br /> necessary changes to the plan and to implement them. <br /> The permittee shall amend the plan whenever there is a change in design, construction, operation, or maintenance <br /> which has a significant effect on the potential for the discharge of pollutants to the waters of the State, or if the <br /> SWMP proves to be ineffective in achieving the general objectives of controlling pollutants in stormwater <br /> discharges associated with mining activity. Amendments to the plan shall be summarized in the Annual or <br /> Compliance Report. <br /> 3. Prohibition of Non-stormwater Discharges <br /> a. Except as provided in paragraph b, below, all discharges authorized by this permit shall be composed entirely <br /> of stormwater. Discharges of water other than stormwater must be addressed in a separate CDPS permit issued <br /> for that discharge. <br /> b. Discharges from the following sources that are combined with stormwater discharges associated with mining <br /> activity may be authorized by this permit, provided that the non-stormwater component of the discharge is <br /> identified in the SWMP (see Part I.B.4.g of the permit): fire fighting activities, uncontaminated compressor <br /> condensate, irrigation drainage, lawn watering, air conditioner condensate, uncontaminated seeps and springs, <br /> and foundation or footing drains where flows are not contaminated. <br /> 4. Releases in Excess of Reportable Quantities <br /> This permit does not relieve the permittee of the reporting requirements of 40 CFR 110, 40 CFR 117 or 40 CFR 302. <br /> Any discharge of hazardous material must be handled in accordance with the Division's Notification Requirements <br /> (see Part II.A.3 of the permit). <br /> 5. Facility Inspections <br /> a. Active Mining Operations. Qualified personnel identified by the operator shall make a thorough inspection of <br /> their stormwater management system, at least twice per year (in the spring and fall). Where semi-annual site <br /> inspections are shown in the plan to be impracticable because an employee is not stationed or does not routinely <br /> visit the site, inspections as required in this part shall be conducted at appropriate intervals specified in the plan, <br /> but never less than once in two years. These inspections must be documented and summarized in the Annual <br /> Report(see Part I.E.1 of the permit). <br /> b. Inactive Mining Operations. Qualified personnel identified by the operator shall make a thorough inspection of <br /> their stormwater management system, at least once per year. Where annual inspections are shown in the plan to <br /> be impracticable, because an employee is not stationed at or does not routinely visit the site, an inspection and <br /> certification is required once every three years by a Registered Professional Engineer that the site is in compliance <br /> with the plan. These inspections must be documented and summarized in the Compliance Report(see Part I.E.1 <br /> of the permit). <br /> c. Remediation Operations. Qualified personnel identified by the operator shall make a thorough inspection of <br /> their stormwater management system, at least once per year(in the field season). Where annual site inspections <br /> are shown in the plan to be impracticable, because an employee is not stationed at or does not routinely visit the <br /> site, inspections as required in this part shall be conducted at appropriate intervals specified in the plan, but never <br /> less than once in two years. These inspections must be documented and summarized in the Annual Report (see <br /> Part I.E.1 of the permit). <br /> d. Inspection Requirements -ALL Operations. The inspections as required above must include the following: <br /> 1) Disturbed areas and areas used for material storage that are exposed to precipitation shall be inspected for <br /> evidence of, or the potential for, pollutants entering the drainage system.
