Although removal of the ponds is called
for in the reclamation plan, the alternative seems advisable in some cases, where the roads which
access the ponds have already been. reclaimed. The effect of either alternative on the discharge
permit, and the views of the Health Department generally, are of considerable, interest and
concern to Mid-Continent.
Further, Mid-Continent has a concern with continuing as permiaee at various discharge
points which it neither owns nor controls. As a practical matter, discharge points at some
outlying areas are now inaccessible due to reclauution of the roads by the DMG-
Because the current permit includes several discharge points, and because of the
substantial change in conditions since the permit was last renewed, it may take a little time to
arrive at a mutually agreeable course of action- Thus, I would like to formally request a letter
from you, as we recently discussed on the telephone, allowing an extension of time to apply for
the permit renewal. I think a two month extension until December 31, 1998 would be sufficient.
Please give these issues your consideration and contact either Geoff Anderson or me at
the number listed above to schedule a meeting as soon as possible. A previous meeting between
bad-Continent and WQCD was inconclusive_ I would like to discuss whether the attendance at
the next meeting of higher level officials would help expedite resolution of this matter and
whether additional agencies should also be represented. .
Respectfully,
137NS,FIG WIL .0
.Higley
i"YI:ll.h
cc: Robert Delaney,Esq.
Diane Delaney, Esq.
20-d VZ:OT 86, Z AuN 8SS2998202:xpd
