You had requested guidance from the Water
Quality Control Division(WQCD) on acceptable reclamation criteria for the above-referenced site,
under a stormwater discharge permit.
The criteria as outlined in your letter will be acceptable for allowing termination of discharge permit
coverage, once the vegetation has become established. I have attached a copy of the text from the
stormwater Metal Mining permit(which also covers coal mines)that is relevant to this situation.
Also note that the basic underlying tenet for coverage of mines is that a stormwater permit is
required only if runoff contacts overburden, raw material, intermediate or finished products, or waste
products, and is then discharged to state waters. It sounds as if completion of the process described
in your letter will eliminate the need for a permit.
It is important to be very clear about what sites will be covered under the Division of Minerals and
Geology's stormwater permit, and what sites will remain under Mid-Continent's industrial discharge
permit. This should be specified in the permit application, as well in as the Stormwater Management
Plan(SWMP). I have enclosed a copy of the application for your use, as well as a copy of the
guidance document for preparing a SWMP.
