Metal Mining SWMP Guidance Document <br /> Page 13 <br /> 4. Comprehensive Inspection <br /> The SWMP shall identify qualified personnel that shall inspect designated areas. Inspections <br /> required by this part shall be conducted annually. Where annual inspections are impracticable, <br /> certification is required once every three years by a Registered Professional Engineer that the site is <br /> in compliance with the SWMP. <br /> See page 10 of this document for an explanation of this item. <br /> 5. Additional SWMP Items for Sites Seeking Permit Termination <br /> There are two methods available to permittees seeking to terminate permit coverage: <br /> 1. Termination through CDMG release - When a site has been reclaimed in accordance with the <br /> Colorado Division of Minerals and Geology (CDMG) requirements and the site has been released <br /> from State reclamation requirements, the operator of the facility may request termination. <br /> 2. Termination through mine-waste remediation - For facilities without CDMG permits, the permit <br /> coverage may be terminated through mine-waste remediation. For mine-waste remediation projects, <br /> additional SWMP items must be developed prior to implementation of the remediation work, as <br /> described below. In addition, permittees seeking coverage under the Voluntary Cleanup Act must <br /> notify the Division of their intent 30 days before any remediation activities commence. <br /> Termination may then be requested once raw materials, intermediate products, byproducts, finished <br /> products and waste products have been removed or isolated from stormwater and the site has been <br /> stabilized (with little evidence of soil erosion or other runoff problem) and revegetated. The following <br /> criteria from the permit (section I.F.1) must be met for the entire mine site, including any on-site disposal <br /> areas: <br /> 1) all raw materials, intermediate products, byproducts,finished products and waste products <br /> (including acid generating material exposed by the mining activity) have been removed or <br /> permanently isolated from stormwater; and <br /> 2) all soil disturbing activities at the site have been completed; and <br /> 3) vegetation has been established ►.ith an average cover or density, over the previously disturbed <br /> area, of a minimum of 40 percent vegetative cover or 70 percent of the vegetative cover of a <br /> similar undisturbed site, %-hccheier is higher (vegetative cover or density determinations need not <br /> be determined scientificalh to extensive measurement and statistical analyses; simple <br /> representative transects are adequate.); or equivalent permanent physical erosion reduction <br /> methods have been employed. <br /> The Division may, after consultation with the permittee and upon good cause being shown, revise <br /> the vegetative cover requirement on a case-by-case basis. <br /> Once termination criteria have been met under one of the above methods, termination of the permit may be <br /> requested. The Division will consider termination of the permit when the following items from section I.F.2 of <br /> the permit are completed: <br /> a. the permittee has submitted a completed Inactivation Form as provided by the Division which <br /> summarizes the work accomplished, <br />
