Metal Mining SWMP Guidance Document ,
Page 2
2. Area Subiect to Effluent Limitations Guidelines
Each plan shall describe the portions of the mining site which contribute runoff to areas subject to
effluent limitations guidelines contained in 40 CFR subchapter N.
Many mining sites are already regulated under other federal and state programs. The federal regulations are
under 40 CFR, Section 440 - Ore Mining and Dressing. This section covers the mining, milling, etc. of metals.
If your site has a discharge of mine water, processing water, a draining portal or adit, or runoff from any active
mining areas, that discharge must be covered under a CDPS industrial discharge permit. This is not the same
thing as your CDPS stormwater permit. The areas from which such discharge occur are then covered under the
industrial discharge permit, and so are not regulated under your stormwater permit.
Some sources of stormwater which are not addressed under effluent regulations are roads and railroad lines,
pond outslopes, inactive loadouts (coal mines), sites for storage and maintenance of material handling
equipment, etc.
If you have any questions on which portions of your site are covered under which permit, call the Water Quality
Control Division at (303) 692-3500.
3. Site Man
Each plan shall provide a site map or maps which indicate at a minimum:
- mining/milling site boundaries and access and haul roads;
- equipment storage,fueling and maintenance areas;
- materials handling areas;
- areas used for storage of overburden, materials, soils or wastes;
- areas used for outdoor manufacturing, storage or disposal of materials;
- location of mine drainage or any other process water;
- tailings piles/ponds, both new and pre-existing;
- mine drainage or any other process water discharge points,
- springs, streams, wetlands and other surface waters; and
- boundary of area that contributes runoff to outfalls that are subject to effluent limitations
guidelines.
For those areas outside of the area that contributes runoff to outfalls that are subject to effluent
limitations guidelines:
- an estimate of the direction(s)of flow;
- stormwater outfalls and an outline of the drainage area of each stormwater outfall,
- each existing structural control measure to reduce pollutants in stormwater runoff, and
- the location of impervious structures (e.g. parking lots, roofs, etc.)
The drainage areas shown should include the portions of the site where industrial activities occur, as well as
those portions contributing stormwater that mixes with runoff from the industrial area. Therefore, the entire
drainage area where industrial activities occur must usually be included.
Aside from mining, industrial activities can include equipment washing, materials storage, vehicle maintenance
or fueling, incineration, waste treatment, storage or disposal, shipping/loading/unloading, etc. You do not need
to include industrial activities which only take place indoors, unless there is some part or aspect of the activity
with which stormwater could come in contact. For example, if all vehicle maintenance is done indoors, but
vehicle storage or fueling is outside, the vehicle storage or fueling area must be addressed.
