Page 2, Permit No. CO-0000396 <br /> Ill_ PURPOSE OF AMENDMENT <br /> The oil and grease section, Pan I.B.1.(c). is being modified to state that anv time an oil sheets and/or floating oil is <br /> observed tot a discharge, a sample shall be collected and corrective action shall occur. This is irrespective of case-hy-case <br /> Division requested samples. <br /> The Divtaon will retain the right under this permit amendment to require the permittee to perform monitoring on a case-by- <br /> case basis. If such monitoring is requested, we will submit a specific request to thepermittee, then they would perform the <br /> monitoring as requested. The monitoring results shall he submitted to the Division immediately upon receipt from the <br /> laboratory or other analytical source.. if effluent limitation exceedences are indicated by the results, the permirree may be <br /> vubjeci ro enforcement action. The Division rriaiitc the right to reopen the permit to reinstate routine effluent monitoring if <br /> the permirtee faiLr to maituain treatrrtent systems at-for any other reason where we find or suspect that compliance is not <br /> uct•urri+rg. <br /> IV. PUBLIC NOTICE COMMENTS <br /> No wrirren commenrs were received during the public comment period. A concerned citizen living in the vicinity of the mine <br /> site was contaard by the Division about this amendment. He expressed verbal comments of a more general nature. His <br /> comments centered on his podtion that the Division or another independeru authority not related to the permirree should be <br /> monitoring the discharges and the receiving stream, Coal Creek, on a routine basis. I indicated that the Division does not <br /> have.+ufftcient budge for this monitoring and therefore cannot perform this monitoring. The NPDES nationwide and CDPS <br /> Colorado discharge permit probramy are based on trust. 77rere are several checks in the system that would tend to indicate <br /> if monitoring results were nor entirely accurare for airy reason. <br /> 777e citizen indicated that he would submit his comments in written form. However, none have been received after <br /> apprommarely 30 days. Since no comments have been recenrd in a timely manner and the expected comments are not <br /> directlh>related in this amendment, the Division is proceeding to issue the amendment unchnnged. if the citizen submits his <br /> comments. the Division will respond to rhem appropriately at that time. <br /> Jon C.
