August 30, 2012 <br />Mr. Peter Hays <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Rm. 215 <br />Denver, CO 80203 <br />Dear Mr. Hays, <br />This letter is in response to the City of Greeley gravel mining operation known as the <br />25 Avenue Site, permit number M- 2002 -020, in Greeley, Colorado. Century Link has a fiber <br />optic line within 200 feet of the 25 Avenue Site proposed mine pit near the intersection of <br />North 35 Avenue and F Street. <br />As we understand it, new mining will not take place in our easement or right -of -way and will <br />stay at least 100 feet from our structure. We also understand that new mining will progress at <br />3H:1 V slopes and, therefore, we acknowledge that the City of Greeley does not anticipate any <br />slope stability issues from the mining and reclamation activities. However, be advised that this <br />does not alleviate the City of Greeley from any responsibility if our structure is damaged due to <br />the mine operation. <br />Thank you, <br />A.
