5. The on -site extracted material will be used for fill to achieve the grades needed for the
channel and park. We would have preferred to balance the earthwork on -site, but the
project area is located within the floodplain of Cherry Creek and any additional fill would
increase the base flood elevations and potentially place structures in the floodplain. The
areas surrounding the project have been developed.
6. The material hauled offsite becomes the property of the contractor doing the project to
legally dispose of. The final use of the material is not known.
7. The project will disturb less than 30 acres.
8. The project will excavate 0 -10' depth.
9. 53,000 cubic yards will be excavated. In order to stabilize Cherry Creek and improve the
drainage, the project is purchasing 12,904 cubic yards of various aggregates and concrete
from the mining and construction industries at a cost to be imported to the project of
$1,189,908.60. This material replaces a portion of the native material that is being
disposed.
10. No explosives will be used on this project.
11. Tributary groundwater will likely be temporarily exposed for construction. A
construction discharge permit from the Colorado Department of Public Health and
Environment (CDPHE) will be obtained by the contractor performing the work and the
contractor will file a Notice of Intent with the State Engineers Office for construction
dewatering.
12. The landowner will not receive any compensation for the work. UDFCD is the public
agency performing the work with public funds and the contractor will be paid to remove
the material.
13. Site landscape and seeding plans are included. The project is reclaiming Cherry Creek
with 28 acres of native grasses, 11,281 willows, 256 trees, and 960 shrubs at a cost to the
project of $283,441.92.
14. Permits obtained for this project are:
a. Individual 404 permit from the U.S. Army Corps of Engineers by UDFCD
b. Stormwater Discharge Permit from CDPHE by UDFCD
c. Grading Erosion Sediment Control Permit from SEMSWA by UDFCD
d. General Construction Permit for Land Development Projects from CDPHE by
UDFCD
e. Construction Dewatering Permit by the contractor
15. The project is 100% funded by local government and agency funds.
16. The intent of this project is to construct drainage improvements and channel stabilization
along Cherry Creek. The project reclaims Cherry Creek, and protects public open space.
The excess material becomes the property of the contractor hired, and the contract
requires it to be disposed of legally. The final use is not known. The contractor is not
selling the excess material, and has been notified that the sale of the extracted /exported
material would require a mining reclamation permit.
DCM\Rich Borchardt \Cherry Crk @ Eco — Div of Recl 917
