Oul
We have come before you at no fault
of ours. We are just farmers, and as farmers we
depended solely on the mine -- on the mine to
present information that was accurate to the
division and for the division to know the rules and
regulations governing prime farmlands as they would
enforce those rules and regulations protecting the
landowner and the landowner rights and the
properties of the landowner as specified in the
act.
We were guaranteed that the land
would be returned to as good as or better than it
was, and we will not accept anything less than what
we had. PR 06 does not provide us with these
conditions.
Section 4.15.11 states that all areas
affected by surface coal mining operations shall be
restored in a timely manner. The land must be
restored to conditions that are capable of
supporting the uses which they were capable of
supporting before any mining to higher or better use
achievable, and PR 06 does not do this.
It has been a misconception that if
you have a lease, you are protected. This is not
true. A lease is just a right of entry.
