BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />EXTENSION OF DEADLINE FOR EXCHANGE OF WITNESS AND EXHIBITS LIST <br />IN THE MATTER OF NEW HORIZON MINE, PERMIT REVISION NO. 6 APPLICATION, <br />PERMIT NO. C- 1981 -008 <br />The Mined Land Reclamation Board ( "the Board "), hereby amends the PROPOSED PRE - <br />HEARING ORDER dated 4- November 2010 to extend the deadline for parties to exchange lists <br />of witness and exhibits as follows: <br />IV. WITNESSES AND EXHIBITS <br />Pursuant to C.R.S. § 24 -4 -105 (4), prior to the hearing, all parties are directed to exchange <br />witness and exhibit lists, and copies of the exhibits they intend to present on the issues identified <br />in the previously issued Proposed Pre - Hearing Order. The witness and exhibit lists, and copies of <br />the exhibits are due by close of business on WEDNEEDAY, NOVEMBER 10, 2010 If an <br />exhibit already exists as a document in PR -06 or the permit file, the document may be referenced <br />on the exhibit list and need not be re- copied. If an exhibit consists of new information that is not <br />already included in PR -06 or the permit file, it must be referenced on the exhibit list AND copied <br />and supplied to the Board and to the other parties. The Board requires that fifteen, three -hole <br />punched copies of the exhibits and witness and exhibit lists (including any new exhibit that does <br />not already exist in PR -06 or the permit file) be provided. The fifteen copies for the Board are <br />also due by close of business on WEDNESDAY, NOVEMBER 10, 2010 <br />Witness testimony shall be limited to the PR -06 issues as set forth in section III in the previously <br />issued Proposed Pre - Hearing Order. <br />All documents, exhibits and photographs admitted by the Board as evidence at the Formal <br />Hearing will become part of the administrative record. Upon request, a party may recover any <br />evidence introduced by that party, if no action for judicial review is commenced within thirty <br />(30) days of the date agency action in this matter becomes effective. <br />
