11 <br />1.4.4 Those sites where sludge is used beneficially as a fertilizer, soil <br />conditioner, fuel or livestock feed, provided the sludge is certified to have <br />met all applicable regulations of the Department and the Department of <br />Agriculture. In addition, the use of manure as a fertilizer or soil conditioner <br />or the composting on the site of generation of manure with other <br />compatible materials necessary for effective composting as part of <br />standard agricultural practice shall not require a certificate of designation. <br />1.4.5 Those facilities for hazardous waste disposal that have been issued a <br />certificate of designation pursuant to Title 25, Article 15, Parts 1, 2, and 3, <br />CRS, as amended, and its regulations. <br />• <br />1.4.6 Transfer stations, which shall not be deemed to be a solid waste disposal <br />site and facility, shall not require a certificate of designation and shall meet <br />standards as set forth in Section 7. <br />1.5 WAIVER PROCESSES AND PROCEDURES <br />1.5.1 If an applicant wishes to request a waiver of any provision of these <br />regulations, written documentation requesting such waiver or waivers shall <br />be submitted to the Department and the local governing authority. Waiver <br />requests shall be site - specific and shall list those regulations or <br />requirements for which a waiver is being requested. The waiver request <br />shall supply sufficient technical information in a clear and concise format to <br />justify the applicant's request. <br />Minimum information required for a waiver request shall consist of: <br />(A) Name and address of the applicant and the owner <br />(B) Site address and legal description <br />• (C) Site or facility name <br />(D) County and township, range, section where the site is located. <br />(E) Type, size, expected active life and operational history of the facility <br />(F) Geological, hydrologic, and engineering and other such information <br />necessary to support the applicants waiver request <br />(G) The specific regulatory subsections for which the waiver request is <br />being filed. <br />July 1, 2007 <br />• <br />30 <br />
