THEREFORE. BE TT RESOLVED by the Board of County Commissioners of Rio <br />Blanco County, Colorado: <br />Page 2 of <br />D. The Special Use Permit application meets the requirements of Sections 54. and 224 of <br />the Land Use Resolution (LUR) as well as all relevant standards specified in Article X of <br />the LUR: <br />E. Western Gravel, LLC has paid the appropriate application fee: <br />F. The record is complete; <br />G. The proposed Special Use Permit is in the best interests of the health, safety, morals, <br />convenience. order, prosperity and welfare of the citizens of Rio Blanco County. <br />A. Special Use Permit, #11 -04 for Western Gravel, LLC is hereby approved, subject to <br />the following conditions: <br />1. Approval of the Special Use Permit is for the area identified in the Design <br />and Operations Plan as Phase 1 only. This area includes the impoundment <br />identified as Cell A and associated stormwater detention structures. <br />2. Before construction and use of additional Cells or area. Western Gravel. <br />Inc. must apply for and receive approval of an amendment to the Special Use <br />Permit tiA, ith each additional cell being a new phase. <br />3. Signage described in the Design and Operations Plan must be maintained <br />throughout the post closure monitoring period. <br />4. The Certificate of Designation will be recorded with the Rio Blanco Clerk <br />and Recorder by the Rio Blanco County Planning Department. <br />5. By acceptance of a Rio Blanco County Special Use Permit. Western <br />Gravel Inc. grants to Rio Blanco County, its agents and employees. permission to <br />inspect the site during normal business hours, without notice, to assess <br />compliance with the terms and conditions of the Special Use Permit and <br />Certificate of Designation. <br />6. Copies of any reports required by CDPHE, or any other state or federal <br />regulatory agency. must be supplied to the Rio Blanco County Planning <br />Department and the Rio Blanco County Environmental Health Department within <br />the same time limits as required for the original report. These reports will be <br />distributed to interested agencies by the County. <br />7. Rio Blanco County reserves the right to require post closure monitoring <br />beyond the time period required by CDPHE. <br />
