In the event that methane is measured at 25% LEL or above, all activities <br />should cease, ignition sources should be extinguished, and all persons immediately leave the area. <br />Operations should resume only when methane levels subside to 20% or less consistently, based upon <br />periodic monitoring. <br />VOCs should be monitored concurrent during methane monitoring activities. Elevated VOC levels can be <br />toxic and are based upon the specific compound of interest. VOCs contained in E &P waste and PCS <br />generally include benzene, toluene, ethylbenzene, and xylene (BTEX). The Occupational Health <br />Administration (OSHA) regulates exposure to benzene with the b enzene standard provided in 29 Code of <br />Federal Registry (CFR) 1910.1028. Levels of benzene are expected to be less than the OSHA action level of <br />0.5 parts per million (ppm). The permissible exposure limit (PEL) is 1.0 ppm for an 8 -hour time - weighted <br />average exposure. <br />In the event that VOC concentrations in air exceed background levels and are sustained at 5 ppm for one <br />minute, all persons should leave the area until VOC levels subside to a consistent level of less than 5 ppm for <br />a period of five minutes. It should be noted that weather conditions (e.g. humidity, moisture) can affect gas <br />accumulation and dissipation. In the event that elevated methane and/or VOC levels do not subside, CDPHE <br />shall immediately be notified. Monitoring equipment used is pr esented in Section 3.13. <br />4.9 FINANCIAL ASSURANCE <br />Financial assurance must be maintained during the operating life and post - closure period of the landfill, in <br />accordance with the Regulations. In accordance with Section 1.8.1 (B) of the regulations, the Owner will <br />prepare a detailed written estimate of the cost of hiring a third party to close the "largest area requiring <br />closure" during the active life of the facility when the extent and manner of its operation would make closure <br />most expensive. Sixty days prior to receipt of any waste at this facility, a bond of sufficient amount will be <br />established and maintained to make certain that payment of closure and post - closure activities will be made. <br />The third party cost estimate will be prepared and updated every 5 years or as necessary based upon <br />construction of new faculties and/or cells under the supervision of a Professional Engineer registered in <br />Colorado. The fmancial assurance cost estimate will be revised annually based upon economic deflation <br />values 'and submitted to CDPHE by October 1 of each year in accordance with the Regulations. <br />4.10 PERMITTING <br />Required permits will be obtained from Rio Blanco County, State of Colorado, and Federal and local <br />authorities in accordance with applicable regulations and ordinances. Several permits were previously <br />obtained. Required permits include the following. <br />• Rio Blanco County Special Use Permit and COD for landfill purposes. <br />• CDPHE, APCD particulate (existing) and VOC emissions. <br />• CDPHE Stormwater Discharge (existing). <br />• Division of Reclamation, Mining, and Safety (existing reclamation permit must be amended) <br />NWCC, Inc. <br />
