The Division approved a <br />liability release of $1,975,695.00 with the approval of SL -3. <br />SCC submitted an application, SL -04, for a Phase I bond release on October 15, 2008. This <br />application was found complete on December 1, 2008. The application requested Phase I <br />release on 135.3 reclaimed acres of permanent program lands. The area requested for release <br />included a 125.8 acre block of reclamation in the southeast portion of the permit area, an 8- <br />acre portion of the reclaimed solid waste disposal site, and a 1.5 acre corridor associated with <br />a postmining drainage channel. These acres were originally associated with SL -1, but not <br />approved at that time. PR -2 also reduced the size of the disturbed area from approximately 2,295.3 <br />acres to the currently permitted 271.2 acres. The Seneca II disturbance area prior to the <br />approval of PR -2 and after the approval of SL -04 consisted of 2,037.59 acres (1,968.8 <br />permanent program lands and 69.79 pre -law lands). Based on the final decision of PR -2, the <br />Seneca II Mine is comprised of 271.20 acres. The Peabody Sage Creek Mine assumes liability <br />of the remaining 1,766.39 disturbed area acres (1,697.6 permanent program lands and 68.79 pre - <br />law lands) based on the approval of CDRMS Permit No. C- 2009 -087. The Peabody Sage Creek <br />Mine disturbed area acreage of 1,766.3 does not include the approved 52.60 disturbed area <br />acreage previously undisturbed by the Seneca II Mine. <br />Seneca II Mine Page 4 September 10, 2012 <br />Phase 11 Bond Release <br />
