Pineda <br />Colorado S <br />1� g Director <br />Re: Southfield Mine, C1981 -014, Citizen's Request for Inspection <br />Dear Dr. Corley: <br />On Friday, August 31, 2012, the Division received an e -mail from you requesting an inspection by DRMS at the <br />Southfield Mine in accordance with Rule 5.02.5(1). Concerns that you cited involved improper labeling of a fuel <br />tank, expired and discharged fire extinguishers, and improper storage of liquid fuel. <br />The Southfield Irvine is a reclaimed underground mine. As such, there are no daily operations on the site. Energy <br />Fuels representative, George Patterson, conducts periodic maintenance of the site. Facilities remaining at the mine <br />site includes a shed, the permanent truck tunnel, two sediment ponds with associated ditches, several access roads, <br />groundwater monitoring wells, a substation, and a graveled parking area. Energy Fuels also has a grader on site, <br />along with a small portable fuel tank on a trailer located adjacent to the sediment control ditch to Pond 5. Two 5- <br />gallon gas cans and some electrical equipment are stored on pallets next to the shed. <br />The Southfield permit addresses storage of a 500 gallon gasoline tank, and a 16,500 deisel/hydraulic oil tank that <br />were used while the operation was active. Since the reclamation of the site and demolition of the facilities, the fuel <br />storage tanks have been removed in accordance with the permit requirements (PAP page 2.05.3 -54). Page 2.05.3 -63 <br />in the Southfield permit commits Energy Fuels to removal of waste oils and lubricants off -site. This permit <br />commitment is inaccordance with Rule 2.05.4(2)(f) and 4.11.4(1). <br />The fuel tank noted in your e -mail, dated 8/31/2012, is stored adjacent to the ditch. Any potential spill from this <br />tank would be contained in the ditch and Pond 5. This containment is in agreement with Energy Fuels SPCC plan. <br />The Regulation of the Colorado Mined Land Reclamation Board for Coal Mining does not define the required <br />signage of fiiel storage, nor does it regulate fire extinguishers. The Division inspected the Southfield mine on <br />August 24, 2012, and did not find evidence of fuel leakage form the tanks noted in your e -mail. <br />In accordance with Rule 5.02.5(4)(b) the Division does not believe that a violation of the Act, Rules, or permit <br />conditions have occurred with regard to the storage of the fiiel tanks and fire extinguishers.
