STATE.CO.US Sent: Friday, September 07, 2012 10:48 AM To: Binns, Janet Cc: Sword, Valerie; Buford, Carl; Hu, Ajin; Karami, Alex Subject: FW: Attached plans for New Elk Mine - Access Permit 210036 and 210037 Hi Janet, I would like to recap our conversation yesterday concerning the New EII< Mine: Yesterday you and I discussed your concerns with the disturbance of some of the property outside CDOT ROW the land discussed belonged to you (Colorado division of Reclamation) the concern was why the mine had disturbed an area on your property while constructing improvements to Hwy 12. 1 informed you the mine was constructing improvements to an existing access (Road B on the plans) they are adjusting the slope of the road as it ties into the highway. The reason for the improvements were to mitigate some safety concerns as well as drainage problems the access has in its current condition, after our conversation you were fine with the improvements and asked if I would send a copy of the plans showing where the improvements were being done to "Road B" for your file. Although the plans do not show the intended construction of the access I will provide you with any details, pictures or information you may need. I have attach a copy of the plans that shows "Road B" if you have any questions of concerns please give me a call.
