The <br />contractor, PVC, had cut this slope further to the north than the highway right of way limits. From the fence line north <br />of the highway, that I assumed to correlate close to the highway R -O -W, the disturbance measured 64 ft. to the north by <br />115 feet to the west from the DRMS approved road. The contractor had removed the material from the previously <br />existing knob. Removal of this knob provided increased visibility for equipment and vehicles coming down the road to <br />the highway, and improved the visibility for drivers on the State highway to see vehicle traffic on the RDA road. Removal <br />of the knob also reduced the steep grade of the RDA road at the intersection with the state highway. <br />Removal of the knob improved safety and water control. You indicated to me that CDOT found these changes <br />acceptable. <br />Also to confirm that I understand the chain of command on this specific project. CDOT issued the <br />acceleration /deceleration lane permit to New EII< Coal Company. New Elk Coal Company contracted with Purgatoire <br />Valley Construction (PVC) who is conducting the actual labor on the project. New EII< Coal Company is ultimately <br />responsible for complying with the terms of the CDOT permit. <br />Please let me know if I misunderstood any of our discussion. <br />If you could forward to me the pertinent portions of the CDOT permit to New EII< Coal Company for this project specific <br />to the NW corner along with a map showing the approved work area, that would be helpful to DRMS.
