1 . Complete the following corrective actions: <br /> a. provide short-term, temporary waste rock acid-production mitigation <br /> measures, submitted to the Division as a technical revision requiring <br /> Division approval prior to plan commencement, by no later than <br /> September 23, 1988; and, <br /> b. provide long-term, final reclamation waste rock acid-production <br /> mitigation plans as well as revised mining/reclamation plans concerning <br /> the Sunnyside Basin Open Pit mining submitted to the Division as a <br /> technical revision requiring Division approval prior to plan <br /> commencement, i.e., by no later than November 22, 1988. <br /> 2. Pay the Colorado Mined Land Reclamation Board a civil penalty in the <br /> amount of $500.00, within 30 days of the signature date of this document. <br /> This is based upon an assessment of $250.00 per day for 26 days of violation, <br /> from July 29, 1988 to August 24, 1988, with $6,000.00 suspended upon <br /> completion of the corrective action outlined in this order. <br /> In clarification of the rights of recipients of Notices of Violation, Cease <br /> and Desist Orders, parties are advised to consult the Colorado Mined Land <br /> Reclamation Act and the State Administrative Procedure Act. <br /> Nothing herein contained, particularly those portions requiring certain acts <br /> to be performed within a certain time, shall be construed as a permit or <br /> license to engage in any prospecting or mining operations within the State. <br /> Persons concerned with judicial review of the provisions of this Order are <br /> advised to consult C.R.S. 2 4-4-106, as amended. <br /> Dated at Denver thi s �- bay of 11 �pV <br /> COLORADO MINED LAND RECLAMATION BOARD <br /> DEPARTMENT OF NAT L RESOURCES <br /> RED .� i& trector <br /> Mined Lane Reclamation Division <br /> FRB/scg <br /> 9771F <br />
