Mrs. Connie Davis with Aggregate Industries was present during the inspection. <br />Aggregate Industries submitted a letter requesting an acreage reduction of approximately 21.15 acres, which <br />would result in a remaining acreage of 48.75 for the site. The reduction request is based on the partial <br />termination of Al's mining lease with the property owners, Greeley Urban Renewal Authority (GURA) and <br />Leprino Foods Company (Leprino). The release is comprised of two areas; a 17.36 acre parcels along the <br />eastern boundary of the site and a 3.79 acre parcel located in the southeast corner of the permit area. <br />3.79 acre parcel <br />This parcel is owned by GURA and contains an agricultural stormwater pond that was potentially to be filled <br />with excess overburden from Al's mining activity, however GURA chose to proceed with another use for the <br />parcel. During the inspection, the parcel was being used by the City of Greeley for a wood chipping operation <br />and as a recycled concrete storage area. The site did not appear to have been disturbed by mining activity. <br />17.36 acres parcels • <br />This area is comprised of 4 parcels; Lot 1, Outlot A, Lot 2 and Outlot B. Leprino purchased Lot 1 and Outlot A <br />from GURA and has constructed a process water pond (Leprino Lagoon) in the parcels. Lot 2 and Outlot B <br />have been removed from the Al lease and remain GURA property. These areas were not mined by Al during <br />the mining lease, but were used for material and topsoil stockpile storage and processing. All mining related <br />equipment has been removed from the areas and the topsoil stockpile has been relocated to the middle of the <br />remaining mine site and was seeded by the GURA. The site access for the mine site remains off of Ash St. <br />though this parcel. <br />During the inspection, the northern portion of the area (Lot 1 and Outlot A) contained the Leprino Lagoon. <br />The site was fenced and was not accessible during the inspection. The lagoon appeared to be lined with <br />plastic and the lower portions of the outside banks were reinforced with rip rap. <br />The Division received a comment letter from the Division of Water Resources regarding the release request on <br />August 8, 2012. A copy of the comment letter was delivered to Al during the inspection. As noted as a <br />problem above, the source of the water contained in the pond and the plastic liner in the pond will need to be <br />addressed by the Operator before the Division can approve the release request. As required by Rule 4.17.2(5), <br />the Division shall release all applicable warranties within 30 calendar days to the Permittee after the date <br />(inspection date) of such finding. If the Operator is not able to address the SEO's comments within 30 days, <br />the Division will deny the acreage release request. <br />The approved post- mining land use for the site is recreation and the pre- mining land use was <br />industrial /commercial. The release request areas appeared consistent with the pre - mining land use. <br />Future Mining <br />The remaining mine site was not active during the inspection and did not appear to have been mined for <br />several years. Al has stopped dewatering operations and the pit has filled with groundwater. Al and GURA are <br />currently working with a different operator to assume the lease and complete mining and reclamation <br />activities at the site. The future operator or Al, if they retain the site, will need to update the mining and <br />reclamation plans and maps to address this acreage reduction in the future. <br />Photographs taken during the inspection are attached below. <br />Page 2 of 4 <br />
