Response to Second Adequacy Review: MLE2 Project <br />DRMS Response No. 3 — The Division believes ALL of Section 19 should be included in the permit boundary. The <br />response indicates portions of the NW ''A & NE 1/4 of the SW ''A are not in the permit boundary. Please confirm all of <br />Section 19 is included in the permit boundary. <br />CC &V Reply: CC &V has confirmed that all of Section 19 is within the permit boundary as shown on <br />Attachment 1, which is a copy of Section 19 from the C1 Drawing with Section lines and quarter - quarter <br />section lines drawn. Based on a review of the files, CC &V believes that this was an indication of the parcels <br />of land that Cripple Creek Victor Narrow Gauge Railroad (CCVNGRR) owned in that section that CC &V <br />acquired on February 22, 2010. <br />DRMS Response No. 5d — Please confirm ID 9479 is NOT within 200 ft of the permit boundary. <br />CC&V Reply: CC &V confirms that MSID 9479 is NOT within 200' of the Permit Boundary as shown on <br />Attachment 2, which is a copy of Drawing C -1 from the application with MSID 9479 identified within a solid <br />black area shaded on the drawing to indicate properties within 200' within that area. <br />DRMS Response No. 22 — The Division understands CC &V has an unofficial weed control plan in place. Please <br />commit to submitting a written version of this plan as an interim weed control plan, which can be updated through a <br />TR when the ISO weed control plan is finalized. The Division requests this interim plan be submitted prior to the <br />next growing season (by June 1, 2013). <br />CC &V Reply: CC &V will submit to DRMS by June 1, 2013 a written `Interim" Weed Control Plan with a <br />"Final" Weed Control Plan to be submitted to DRMS by September 1, 2013. <br />DRMS Response No. 30 — The Division received 98 mail receipts, there are 101 Owners listed in Exhibit O. It <br />appears we are missing 1) Brown, B D Kimberly; 2) Colorado Casino Resorts; and 3) Shiloh Plain Inc. Please <br />provide these missing receipts. <br />CC&V Reply: CC &V provides in Attachment 3 copies of the Return Receipts for 1) Brown, B D Kimberly; 2) <br />Colorado Casino Resorts; and 3) Shiloh Plain Inc. Brown, B D Kimberly was delivered at 3:54:00apm on <br />March 29, 2012, 2) Colorado Casino Resorts was delivered at 10:47am on March 26, 2012, and 3) Shiloh <br />Plain Inc. was delivered at 1:23pm on March 26, 2012. <br />DRMS Response No. 36 — The Division's original comment referenced Page 4 -8, 2nd and 3rd bullets — The <br />statement that "All precipitation water infiltrating to ground water through MLE2 mine facilities ... will pass by <br />subsurface flow paths through the diatreme ... ". The last line of your response suggests not all, but only "some <br />infiltrating water migrates towards the regional ground water system." Please provide clarification as to whether it is <br />some or all with respect to the MLE2 facilities. <br />CC &V Reply: To reiterate, all mining areas in the MLE2 Application are within the Diatreme. As discussed <br />in Section 2.4.2 of Cresson Project Hydrogeochemal Evaluation in Attachment 1 of Volume II of the <br />Application, the infiltration behavior in the Diatreme and the Precambrian rockmass immediately adjacent to <br />the Diatreme has been established by installation and monitoring of 23 nested well sets and 13 piezometer <br />strings in single boreholes. These wells show vertical head conditions to the Diatreme. The downward <br />vertical gradient results for all well clusters analyzed are summarized in Table 4, and presented for the <br />District in Plate 10 of the Cresson Project Hydrogeochemical Evaluation. The area where infiltration <br />capture occurs is shown on Plate 10. The following observations about groundwater are made: <br />1. There is a strong downward vertical hydraulic gradient in all locations where the dominant geology <br />is Tertiary volcanic phonolites and welded breccia (i.e. within the Diatreme). <br />
