This was a normal monitoring inspection conducted by TC Wait of DRMS. Mr. Myron Mullett of Mullett <br />Excavating was aware of the site inspection, but was not available to be on site during the site visit. The site is <br />located about 5.5 miles west of Tyrone. Post -mine land use for this site is rangeland. The permit area is <br />approximately 23.3 acres; about 9.5 acres of the permit appears to have been disturbed at the time of the site <br />visit. <br />At the time of the inspection, the site was dry. Access was by vehicle and foot. There was a sign at the mine <br />entrance; however it did not include the required information. Per rule 3.1.12 (1), the permit sign should include <br />the name of the Operator, a statement that a reclamation permit has been issued by the MLRB, and the permit <br />number. This is cited as a problem in this report and will require corrective actions taken by the Operator. The <br />permit boundaries were marked with metal stakes. All mining activity appears to be within the marked <br />boundaries. <br />The mine pit includes nearly vertical cut slopes into the Niobrara formation. A crushed rock stockpile (about 12k <br />cubic yards) is located along the eastern side of the pit, and topsoil stockpiles appear to be located on the south <br />and west sides of the pit. The topsoil is vegetated and stable. There was some trash on site (old pallets, metal <br />material, plastic buckets, etc) that should be removed. <br />Availability Of Records: <br />All records appear up to date. <br />Backfilling and Grading: <br />Pit slopes are near - vertical. No backfilling or grading has occurred. <br />Hydrologic Balance: <br />Site is dry - no evidence of groundwater in pit. <br />Gen. Compliance With Mine Plan: <br />Site appears to be following mine plan on file. <br />Reclamation Success: <br />No reclamation has been conducted at the time of the site visit. <br />Revegetation: <br />No seeding has occurred at the site. <br />Topsoil: <br />Topsoil is stockpiled and appears stable. <br />OBSERVATIONS <br />PERMIT #: M- 2000 -115 <br />INSPECTOR'S INITIALS: TCW <br />INSPECTION DATE: August 27, 2012 <br />Page 2 of 4 <br />
