The Division is required to make an approval or denial decision no later than <br />September 6, 2012 therefore; a response to the following adequacy review concerns should be <br />submitted to the Division as soon as possible. <br />1. On Page 3 of the technical revision submittal in the Mining Plan section, the Operator states the <br />lake will have a surface area of approximately 29 acres. The Reclamation Plan map included in <br />the technical revision indicates a reduced lake size with the removal of the southeast corner of <br />area being backfilled and deeded to the City of Greeley. Please revise the anticipated lake area <br />to account for the reclamation plan change. <br />2. As required by Rule 3.1.5(2), when backfilling is a part of the plan, the Operator shall replace <br />overburden and waste materials in the mined area and shall ensure adequate compaction for <br />stability and to prevent leaching of toxic or acid - forming materials. Please revise the updated <br />reclamation plan to address the requirements of this rule by describing the backfilling operation <br />for the slopes. <br />3. Rule 6.2.1(2) requires maps be signed by a registered land surveyor, professional engineer, or <br />other qualified person. The Exhibit F map submitted to the Division was not signed. Please <br />resubmit a signed copy of the map. <br />6.4.19 EXHIBIT S - Permanent Man - made Structures <br />Where the mining operation will adversely affect the stability of any significant, valuable and <br />permanent man -made structure located within two hundred (200) feet of the affected land, the <br />applicant may either: <br />Office of Office of <br />Denver • Grand Junction • Durango Active and Inactive Mines <br />
