6. Pursuant to the permit, Sunnyside Gold samples the effluent <br /> being discharged to Cement Creek. The permit authorizes four discharge <br /> points. Sunnyside Gold submitted reports to the Division which included the <br /> following effluent data: <br /> Maximum Concentration, <br /> Date Outfall Pollutant in milligrams per liter, "mg/l" <br /> September 11, 1986 004 Total Suspended <br /> Solids, ("TSS") 74.0 <br /> September 17 , 1986 004 TSS 36. 5 <br /> September 24, 1986 001 TSS 53.7 <br /> September 30, 1986 004 TSS 44.5 <br /> October 9, 1986 004 TSS 38.7 <br /> October 17, 1986 001 TSS 44. 5 <br /> 7. Based on reports submitted to the Division by Sunnyside Gold, <br /> the 30-day average concentrations at outfall 004 for September, 1986 for zinc <br /> and TSS were 9.14 mg/l and 43. 7 mg/l respectively. <br /> 8. Cement Creek is "state waters" as defined by 25-8-103(19) , <br /> C.R.S. (1982) . <br /> NOTICE OF VIOLATION <br /> You are hereby notified that the facts stated above constitute 8 <br /> violations of Part I.A. of the permit, as set forth below: <br /> 1. The concentrations of TSS in the effluent on September 11, <br /> September 17, September 30, and October 9, 1986 at outfall 004 and on <br /> September 24 and October 17, 1986 at outfall 001 exceed the daily maximum <br /> allowed by the permit of 30 mg/l based on a grab sample. <br /> 2. The 30-day average zinc concentration at outfall 004 for <br /> September, 1986, exceeds the 30-day average concentration allowed by the <br /> permit of 8.3 mg/l, based on a minimum of three samples in a 30-day period. <br /> 3. The 30-day average TSS concentration at outfall 004 for <br /> September, 1986, exceeds the 30-day average allowed by the permit of 20 mg/l, <br /> based on a minimum of three samples in a 30-day period. <br /> -2- <br />
