7.1-1 <br /> Sub-Section 7 . 1 <br /> CHARACTERISTIC OF EP TOXICITY REGULATION <br /> A solid waste exhibits the characteristic of EP <br /> toxicity if , using the test methods described in Appendix II <br /> of 40 CFR Part 261 or equivalent methods approved by the <br /> Administrator under the procedures set forth in 40 CFR 260 .20 and <br /> 260.21, the extract from a representative sample of the waste <br /> contains the contaminants listed in Table 7 . 1-1 at a concen- <br /> tration equal to or greater than the respective value given im <br /> that Table . Where the waste contains less than 0. 5 percent filter- <br /> able solids , the waste itself , after filtering , is considered <br /> to be the extract for the purposes of this section. <br /> A solid waste that exhibits the characteristic of <br /> EP toxicity, but is not listed as a hazardous waste in <br /> Subpart D, has the EPA Hazardous Waste Number specified in <br /> Table 7 .1-1 which corresponds to the toxic contaminant <br /> causing it to be hazardous . <br />
