Box 177 <br /> Silverton, Colorado 81433 <br /> Re: 41d King Mine's Position on Permanently Plugging the American Tunnel <br /> Dear Mr. Perino: <br /> This letter confirms our discussion and acknowledges that Gold King Mines Corporation, <br /> as owner of the American Tunnel, is aware of Sunnyside Gold Corporations's intent and plans to <br /> permanently seal the American Tunnel with concrete bulkheads in order to eliminate drainage to <br /> the surface through the tunnel from the Sunnyside Mine and the American Tunnel. Sunnyside <br /> Gold Corporation is undertaking this project at its own expense to eliminate obligations under its <br /> CDPS discharge permit. Permitting for this project will be under Sunnyside's Mined Land <br /> Reclamation Permit issued by the Colorado Mined Land reclamation Board and a voluntary <br /> Consent Decree agreement with the Colorado Department of Public Health and Environment - <br /> Water Quality Control Division. Gold King Mines Corporation has no objections to this project <br /> and, under the existing circumstances, believes it is in the best interests of everyone for this <br /> project to proceed. <br /> This letter is for Sunnyside's file and can be submitted to regulatory agencies for <br /> Sunnyside's permitting purposes.
