The above - mentioned site has had one or more problems noted that, according to Division of
Reclamation, Mining and Safety (Division) records have not yet been resolved. According to our
records, the following problems were to be resolved on or before July 2, 2012. Listed below are
descriptions and corrective actions for the problems. Please resolve the corrective actions and
provide evidence of such resolution on or before September 14, 2012. The Operator may also
provide the Division with an update of the status of each corrective action along with a request to
extend the corrective action date.
Please note that if the corrective action(s) are not properly addressed, and evidence provided to
the Division by the date provided above, the listed problems could be escalated to the level of
possible violations and would then be referred to the Mined Land Reclamation Board for further
action.
1. Problem: The site is utilizing off -site fill without prior approval by the Division per 3.1.5(9)
of the Rule.
Corrective Action: The operator shall provide a notarized affidavit, stating that the fill is, in
fact, inert and addressing all requirements pursuant to Rule 3.1.5(9), which describes the
intended use of inert /off -site fill by the corrective action date.
2. Problem: The mine identification sign was not posted at the entrance of the mine site. This is
a problem for failure to post a mine identification sign as required by Section 3.1.12(1) of the
rule.
Corrective Action: The operator shall, at the entrance of the mine site, post a sign which
shall be clearly visible from the access road with the following: the name of the operator, a
statement that a reclamation permit for the operation has been issued by the Colorado Mined
Land Reclamation Board; and the permit number. The operator shall submit photo
documentation that a proper sign has been posted by the corrective action date.
