Pineda <br />Director <br />The above - mentioned site has had one or more problems noted that, according to Division of <br />Reclamation, Mining and Safety (Division) records have not yet been resolved. According to our <br />records, the following problems were to be resolved on or before July 2, 2012. Listed below are <br />descriptions and corrective actions for the problems. Please resolve the corrective actions and <br />provide evidence of such resolution on or before September 14, 2012. The Operator may also <br />provide the Division with an update of the status of each corrective action along with a request to <br />extend the corrective action date. <br />Please note that if the corrective action(s) are not properly addressed, and evidence provided to <br />the Division by the date provided above, the listed problems could be escalated to the level of <br />possible violations and would then be referred to the Mined Land Reclamation Board for further <br />action. <br />1. Problem: The site is utilizing off -site fill without prior approval by the Division per 3.1.5(9) <br />of the Rule. <br />Corrective Action: The operator shall provide a notarized affidavit, stating that the fill is, in <br />fact, inert and addressing all requirements pursuant to Rule 3.1.5(9), which describes the <br />intended use of inert /off -site fill by the corrective action date. <br />2. Problem: The mine identification sign was not posted at the entrance of the mine site. This is <br />a problem for failure to post a mine identification sign as required by Section 3.1.12(1) of the <br />rule. <br />Corrective Action: The operator shall, at the entrance of the mine site, post a sign which <br />shall be clearly visible from the access road with the following: the name of the operator, a <br />statement that a reclamation permit for the operation has been issued by the Colorado Mined <br />Land Reclamation Board; and the permit number.
