The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). Rob Bergmann and Reese Foster were present on behalf of Red Rock Exploration. The Sara Rose site <br />is located approximately 6 miles west of Alma, CO in Park County; the site is on U.S. Forest Service (USFS) <br />property. <br />The Division received notification that the USFS had approved a Plan of Operations for a prospecting operation <br />to be conducted by Red Rock Exploration. A review of the Division's database of permitted sites showed that a <br />Notice of Intent (NOI) to conduct prospecting (DRMS File No. P- 2009 -010) had been issued to Mr. Kevin <br />Lawrence on November 19, 2009. The NOI authorized Mr. Lawrence to conduct prospecting on the Sara Rose <br />claim. The Division has verified that Mr. Lawrence is deceased and the Sara Rose claim has been transferred to <br />Mr. Michael Bergmann. NOI's are non - transferrable; therefore, Red Rock Exploration, LLC must apply for a <br />new NOI in order to conduct prospecting at the Sara Rose claim. The Division received an NOI application from <br />Red Rock Exploration on August 7, 2012. The NOI application is currently under review and the decision date is <br />October 23, 2012. The purpose of the inspection was to verify that Red Rock Exploration has not commenced <br />prospecting operations prior to receiving approval from the Division. Pursuant to C.R.S. 34 -32 -123, any <br />operator or prospector who operates without filing a NOI shall be subject to a civil penalty of not Tess than <br />fifty dollars nor more than two hundred dollars per day for each day the land has been affected. As noted <br />above, an active NOI for the Sara Rose claim has been in effect since 2009. In addition, there is a substantial <br />amount of historic mining disturbance in the vicinity of the Sara Rose claim. <br />The Division met the representatives of Red Rock Exploration on County Road 8 along Buckskin Creek. A <br />locked gate is present at the base of the road which leads to the main portal. The access road is approximately <br />2,100 feet in length and 8 -10 feet in width. The road begins at tree -line and cuts through a talus slope; no <br />vegetation or topsoil was removed to construct the road. The road terminates at an elevation of <br />approximately 12,500 feet at the lower portal. The portal entrance was covered with waste rock to prevent <br />unauthorized entry into the mine. In addition, there are pecker poles and a locked gate behind the waste rock. <br />Below the portal, on top of the waste rock pile, there was an equipment storage area which contained timbers <br />that were hauled to the site in 2011. The timbers will be used to shore up the portal entrance. Also, there was <br />an historic shed located next to the storage area. The shed may be used to store equipment in the future. <br />Based on the observations made during this inspection, all disturbances at the site either occured under the <br />NOI issued to Mr. Lawrence or are historic mining disturbance. Therefore, the Division will not pursue <br />enforcement actions for prospecting without an NOI.
