This bulkhead is located <br /> approximately 8000' from the portal(SGC's property line) and has been in service since <br /> 1996 when the valve on the drainage pipe through the bulkhead was closed and drainage <br /> from the Sunnyside Mine was contained within the Sunnyside Mine workings. SGC has <br /> continued to treat water entering the American Tunnel downstream of the bulkhead (Gold <br /> King property) according to the terms of TR-14, SGC's discharge permit and the related <br /> voluntary Consent Decree agreement with CDPBE-WQCD. <br /> The Consent Decree agreement provides the framework for settlement of issues with <br /> WQCD related to the elimination of drainage from the American Tunnel and Terry <br /> Tunnel which TR-14, in part, addresses. TR-14 does not provide (DMG) approval of the <br /> design and placement of the additional bulkheads needed to complete the closure of the <br /> American Tunnel and eliminate drainage to surface through the tunnel. TR-14 was phase <br /> 1 of the closure process for the American Tunnel and Terry Tunnel. <br /> SGC believes that phase 1 has been completed with establishment of mine pool physical <br /> equilibrium and has implemented phase 2 of the closure process for the Terry Tunnel <br /> (TR-22).
