A copy of the minutes of the January 25-26, 1978 Mined Land Reclamation <br /> Board meeting relating to the approval of the permit application <br /> for this mining operation is enclosed . <br /> RECOMMENDATIONS: <br /> 1 . The operator is to be commended for the success of the revegetation <br /> research on the mill tailings. This work should be continued and expanded <br /> -in scope as soon as possible. Research on revegetation of acid waste <br /> rock should also be continued. <br /> 2. An examination of the file for this operation, coupled with the <br /> observation of the leakage from the active tailings impoundment demonstrates <br /> `that the operator has not, to date, made an effort to comply with the <br /> first of the two stipulations to the permit (as appended to the Board 's <br /> motion approving the permit application) . The operator should take the <br /> following two actions within the next 30 days: <br /> a. Inform the Division as to the plans for compliance with stipulation <br /> 1 of the permit and the probable time schedule for carrying out <br /> those plans. <br /> ' b. Ihform the Division as to the plans for elimination or drastic <br /> reduction of the seepage from the tailings impoundment into the <br /> groundwater system and into the adjacent Animas River. A cutoff <br /> ! trench and pump-back system may not be sufficient if tailings solution <br /> penetration into the groundwater system has moved deeper than the <br /> planned depth of such a trench. <br /> 3. Implementation of items a . and b. above may entail Board appro%al of <br /> an amendment or technical revision to the permit.
