Mike Boulay -2- August 23, 2012 <br />BLM will not approve the coal mine waste pile, the project in its entirety cannot go <br />forward. <br />Therefore, MCM withdraws from consideration the following components; <br />• Coal Mine Waste Pile relocation and expansion <br />• Sediment pond relocation and expansion <br />• Topsoil and Construction Materials storage piles relocation and expansion <br />• New Air Jig coal cleaning facilities <br />The adequacy response, when submitted, will contain at a minimum the following <br />components; <br />❑ Permit boundary revision relating to the lease modification area and expanded <br />mine plan <br />• Updated geology structure maps that have been digitized <br />• Miscellaneous map updates relating to the lease expansion area <br />• Revised permit text relating to the mine expansion and lease modification <br />• Environmental studies associated with the lease expansion <br />There will be no new surface disturbance proposed with the forthcoming adequacy <br />response. The surface facilities configuration will revert back to the currently approved <br />permit document. <br />It is anticipated that a Record of Decision (ROD) for the lease modification EA will be <br />issued by the end of November. Once the ROD is issued, it will be incorporated into the <br />PR -02 adequacy response package. <br />Preparing a revised adequacy response specific to the aforementioned components will <br />require approximately 30 days.
