Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />The Division of Reclamation, Mining and Safety (Division) has completed its review of CC &V's <br />responses to the Division's preliminary adequacy review for your 112d -3 Reclamation Permit <br />Amendment Application (AM10) /Mine Life Extension 2 (MLE2) for the Cresson Project. This includes <br />the hand - delivered submittal dated August 21, 2012. The following comments retain the number system <br />used in your response. <br />Response No. 3 – The Division believes ALL of Section 19 should be included in the permit boundary. <br />The response indicates portions of the NW '/a & NE 1/4 of the SW '/a are not in the permit boundary. <br />Please confirm all of Section 19 is included in the permit boundary. <br />Response No. 22 – The Division understands CC &V has an unofficial weed control plan in place. Please <br />commit to submitting a written version of this plan as an interim weed control plan, which can be updated <br />through a TR when the ISO weed control plan is finalized. The Division requests this interim plan be <br />submitted prior to the next growing season (by June 1, 2013). <br />Response No. 30 – The Division received 98 mail receipts, there are 101 Owners listed in Exhibit O. It <br />appears we are missing 1) Brown, B D Kimberly; 2) Colorado Casino Resorts; and 3) Shiloh Plain Inc. <br />Please provide these missing receipts. <br />Response No. 36 – The Division's original comment referenced Page 4 -8, 2nd and 3rd bullets – The <br />statement that "All precipitation water infiltrating to ground water through MLE2 mine facilities ... will <br />pass by subsurface flow paths through the diatreme ... ". The last line of your response suggests not all, <br />but only "some infiltrating water migrates towards the regional ground water system." Please provide <br />clarification as to whether it is some or all with respect to the MLE2 facilities. <br />Response Nos. 41c, 47c & d – The Division reserves the right to comment on these responses when the <br />final responses from AMEC are submitted. <br />Attachment 10, Mill Site Earthworks Drawings, dated August 16, 2012: <br />A170 – Please confirm the 48 -inch diameter HDPE SDR11 riser pipe is adequate to support itself given <br />the number of perforations at the bottom. <br />Office of <br />Office of <br />Mined Land Reclamation <br />Denver • Grand Junction • Durango Active and Inactive Mines <br />
