6. On July 31, 2012 the Operator signed a Staff Summary Form for <br />Consent Agenda Items, agreeing to the Division's recommendation that the <br />Board approve Operator's request to extend the corrective action clue date to <br />September 14. 2012. <br />McAtee Construction Co. <br />Green Bros. Pit, File No M -1995 -030 <br />Extension Request, MV -2012-015 <br />CONCLUSIONS OF LAW <br />7. The Board has jurisdiction over this matter pursuant to the Colorado <br />Land Reclamation Act for the Extraction of Construction Materials, Article 32.5 of <br />Title 34, C.R.S. (2011) ("Act"). <br />8. The Board has discretion to extend the corrective action due date. <br />ORDER <br />Based on the foregoing, the Board GRANTS the Operator's request for an <br />extension. The required conversion application must be in an approvable form by <br />September 14, 2012. <br />DONE AND ORDERED this ,2 day of ,4(,e, r 2012. <br />FOR THE COLORADO MINED LAND <br />RECLAMATION BOARD <br />Ron Peterson, Chair <br />NOTICE OF APPEAL RIGHTS <br />This order becomes effective and final upon mailing. (2011).
