b. There is one property found on Drawing C -la that appears to be within 200 feet of the permit <br />boundary, but is not listed in Exhibit O. Please provide clarification as to why the property labeled as <br />"002 — Ragan, Michael A" is not included in Exhibit O. <br />RESPONSE: CC &V reviewed on -site records of this property labeled as "002 — Ragan, Michael A ", and <br />then reviewed records at Teller County Assessors' database and found that owner is "Furr, Mary ". Notice <br />was included as listed under "Furr, Mary " as Account R0020689 in Exhibit O. <br />7. Drawing C -2 — There are two sediment control ponds labeled "EMP 006 ": one in Section 30, the other in <br />Section 31. Please relabeled as appropriate. <br />RESPONSE. The labels for the two sediment control ponds are appropriate and do not need to be relabeled. <br />Under Amendment No. 8 to M -1980 -244, the combination of two sediment control ponds labeled "EMP 006" <br />made up the storm water storage capacity for the area of design. The original sediment control pond in <br />Section 30 was located just east of the location of the sediment control pond as it is referenced in Drawing C- <br />2. For Mine Life Extension (`Amendment No. 9'), the original location of the sediment control pond in <br />Section 30 needed to be relocated to allow for construction of the approved portion of Phase 5 of the Valley <br />Leach Facility. Drawing C -2 appropriately reflects the two sediment control ponds that make up "EMP 006" <br />and no relabeling is required <br />8. Drawing C-3 — Please add the proposed permit boundary to Drawing C -3. <br />RESPONSE. A revised Exhibit C -3 is included as Attachment 4 to include the proposed Permit Boundary. <br />9. Drawing C4 — The legend in Drawing C4 includes a water line. The Division cannot find a water line on the <br />drawing. Was the water line omitted or should it be eliminated from the legend? <br />RESPONSE: A revised Exhibit C -4 is included as Attachment 5 with reference to the water line label within <br />the drawing legend removed from the drawing. <br />10. Drawing C-5 — Active mining in the North Cresson Mine (Globe Hill) area in years 2020, 2021, and 2024 — <br />2025 appear very close to the permit boundary and the Mollie Kathleen tourist mine. <br />a. Has CC &V considered the impact blasting in that area may have on the safety and stability of the <br />tourist mine? Please provide a narrative. <br />RESPONSE: Safety of CC &V workers and the public are of the upmost concern to CC &V. Ground <br />Vibration levels that preclude damage to residential structures, particularly damage to drywall or plaster -on- <br />lath, are significantly more conservative than vibration levels typically applied to preclude rockfall in <br />underground workings. CC &V has committed to a monitoring program on the surface above the nearest <br />underground working that approaches the permit boundary. CC &V has had discussions with the owners of <br />the Mollie Kathleen tourist mine and all parties are comfortable in application of the ground vibration <br />criteria set forth in the current CC &V mine permit. <br />b. Does CC &V have accurate underground maps of the Mollie Kathleen Mine that can be used to <br />assess the proximity of the tourist mine's underground workings to the planned North Cresson pit <br />wall? Please provide a narrative. <br />RESPONSE: CC &V does not possess accurate underground maps of the Mollie Kathleen Mine that can be <br />used to assess the proximity of the tourist mine's underground workings to the planned North Cresson mining <br />area walls. The Mollie Kathleen Mine is owned by another entity and CC &V is not privy to that information. <br />11. Drawing C-6 — Please clarify what time -frame of the mine process is presented on the plan view in the <br />upper left corner of the drawing. <br />RESPONSE: The time frame of the mine process presented on the plan view in the upper left corner in <br />Drawing C -6 is for the maximum build out of the Cresson Project as it would occur for the MLE2 Project <br />with facility build out in approximately 2025 before final reclamation activities occur in the main mining and <br />overburden storage areas. <br />6.4.5 EXHIBIT E - Reclamation Plan <br />
