of conveying the runoff from a 10 -year, 24 -hour storm to the retention ponds. The ditch will be <br />reclaimed and the ground surface reshaped to its approximate original contour. The plan calls <br />for reseeding with an irrigated pasture /poorly drained phase seed mix (generally similar to the <br />pre - disturbance swale /vegetation type). Finally, topsoil disking activities will overlap adjacent <br />non - disturbed native vegetation to hasten reinvasion of the native plants. <br />WATER RIGHTS <br />The surface water rights, namely, the share holders of Colorado Cooperative Company 2nd Park <br />Lateral are listed in Appendix 2.04.7 -2 of Section 2.04.7. The ground water rights (water wells) <br />adjacent to the New Horizon North mining area are listed in Table 2.04.7 -4 of Section 2.04.7. <br />The water rights inventory boundary includes all water rights within a one mile radius of the <br />New Horizon North Mine. <br />ALTERNATIVE WATER SUPPLIES <br />WFC has secured 27 shares (0.83 cfs or about 271.6 ac- ft/yr.) of CCC 2nd Park Lateral water <br />from the Garveys during mining with a coal mining surface lease. WFC has an option to <br />purchase land and 20 water shares (0.62 CFS) from the Meehan's, to be exercised upon DRMS's <br />approval of the permit. Further alternative water supplies are the 114.5 acre foot consumptive <br />use credit of Colorado Cooperative Company (CCC) water, and the absolute storage right in <br />NPDES Pond 001 (at the New Horizon 1 reclaimed mine area of 4 acre feet. No mitigation of <br />any ground water impacts is anticipated. All of the above water sources are considered as <br />alternative water supplies that could be used as part of WFC's augmentation plan for mitigating <br />potential surface water rights impacts. It is estimated that WFC, following augmentation usage, <br />will still have available approximately 54 acre -feet of excess consumptive use credit of (CCC) <br />water. The alternative water sources will be selected based on the pre - impact quantity and <br />quality of the source to be mitigated. <br />PROTECTION AND MITIGATION PLAN <br />Introduction Only, minor potential hydrologic impacts have been identified as having any <br />significance at the New Horizon North mining area. Surface water rights (flows) within the <br />influence of the pit inflow drawdowns will be protected and unabated by the diversion of the 2nd <br />Park Lateral ditch into a HDPE pipeline. The ditch water will be diverted around the mining <br />area until the pit has migrated far enough north to allow the pipeline to be rerouted to its <br />approximate original location. Rerouting the pipeline instead of putting the water back in a ditch <br />prevents the ditch water from being lost in the permeable backfill. A detailed augmentation and <br />water rights plan is presented in Appendix 2.05.6(3) -1c and any potential impacts will be fully <br />mitigated. <br />In addition to the mining practices designed to minimize disturbances to the hydrologic balance <br />previously discussed, comprehensive ground and surface water monitoring plans have been <br />Section 2.05.6(3) Page 4 April 2011 <br />
