10. Surrender <br />Lessee covenants and warrants that at the expiration, termination, or cancellation of the <br />Lease, Lessee will quit and surrender said Premises in a good state and condition, <br />reasonable wear and tear excepted. Lessee further covenants and warrants that all <br />improvements, installed, erected, attached, or placed by Lessee in, on or about said <br />Premises under the terms of this Lease shall be removed by Lessor. The Lessor shall <br />have the right on such expiration, termination, or cancellation to enter upon and take <br />possession of said Premises, with or without process of law, without liability for trespass. <br />11. Inconvenience During Construction <br />Lessee recognizes that from time to time during the term of this Lease it may be <br />necessary for the Airport to initiate and carry forward extensive programs of construction, <br />reconstruction, expansion, maintenance and repair in order that the Airport may be <br />suitable for air traffic and flight activity. Lessee agrees that no liability shall attach to the <br />Lessor, Its officials, agents, employees, contractors, subcontractors and representatives <br />by reason of such temporary inconvenience or interruption, and waives any right to claim <br />damages or other consideration thereof. This waiver shall not extend to, nor be construed <br />to be a waiver of, any claim for physical damage to property resulting from negligence or <br />willful misconduct by the Lessor. <br />12. Assignments <br />This Lease is not assignable by Lessee. <br />13. Agreements with United States <br />This Lease is subject and subordinate to all existing or future terms, reservations, <br />regulations, restrictions, provisions, conditions, and statutes of the United States, and any <br />existing or future agreements between the Airport and the United States, relative to the <br />operation or maintenance of the Airport and its appurtenant facilities. <br />14_ Notice <br />Any notice to be given under this Lease shall be served by certified mail, return receipt <br />required, and directed to the other party at the address herein noted. When so given, the <br />dale of notice shall be effective from the date of mailing. Lessee shall be responsible for <br />notifying Lessor of any change of mailing address. Unless otherwise noted the address of <br />the Lessor shall be: Airport Administration, 2100 Airport Road, Montrose, CO 81401. <br />The address of the Lessee shalt be: P.O. Box 628, Nucla, CO 81424. <br />3 <br />
