LAND LEASE AGREEMENT <br />THIS LEASE made and entered this 18`" day of September, between MONTROSE COUNTY, <br />COLORADO, hereinafter referred to as the "Lessor", and, WESTERN FUELS - COLORADO, <br />NEW HORIZON MINE, hereinafter referred to as the "Lessee." <br />WHEREAS, Lessor is owner and operator of Hopkins Field - Nuda, together with the land on <br />which said airport is located in the County of Montrose, State of Colorado, hereinafter referred to <br />as the "Airport"; and <br />WHEREAS, Lessee is desirous of leasing from Lessor a parcel of land, said parcel being <br />approximately four acres in size and located within the western limits of the Airport, for the <br />purpose of a vegetation reference area; <br />NOW THEREFORE in consideration of the payments, covenants, and agreements herein set <br />forth, the parties mutually agree as follows: <br />1. Premises <br />The Lessor hereby leases unto the Lessee for the term and upon the rental conditions <br />herein, the real property on the Airport, as more specifically described on the attached <br />Exhibit A, incorporated herein by this reference, and hereinafter referred to as the <br />"Premises ". The Premises consists of four (4) acres of land owned by Lessor. Lessee <br />shall also have the non - exclusive right of access to and from the Premises over and <br />across the Airport property in specifically designated areas, said access not to interfere <br />with any aircraft activity. <br />2. Term and Options <br />The Lessor hereby leases the Premises unto the Lessee for a period of two (2) to five (5) <br />days per year over the life of the mine (approximately 15 years). The Lessee shall notify <br />the Lessor not less than five (5) business days prior to beginning each study session. <br />3. Rent <br />There shall, be a zero dollar ($0.00) rental assessment for the specified use of Premises. <br />4. Improvement and Use <br />4.1 Use of Premises <br />The Premises shall be utilized by the Lessee as a vegetation reference area to <br />gauge the reclamation success on mined lands. Lessee shall have no right to <br />utilize said Premises, or any improvements thereon, other than as specifically <br />allowed under this paragraph. <br />
