RECEPTION #: 823670, 04/05/2011 at 09:58:44 AM, 1 OF 2, RES FRANCINE <br />TIPTON -LONG, MONTROSE COUNTY, CO CLERK AND RECORDER <br />RESOLUTION NO. 17 -2011 <br />OF THE MONTROSE COUNTY BOARD OF COUNTY COMMISSIONERS <br />CONCERNING: NEW HORIZON NORTH MINE SPECIAL USE <br />(SU -10 -0020) <br />WHEREAS, the Board of County Commissioners considered the New Horizon North Mine <br />Special Use at their regularly scheduled meeting on AprIl 4, 2011. <br />WHEREAS, the Board of County Commissioners APPROVED the New Horizon North Mine <br />Special Use. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County <br />of Montrose, State of Colorado that the New Horizon North Mine Special Use submitted by <br />Western Fuels - Colorado, LLC is hereby APPROVED with the following: <br />Findings of fact: <br />a) The proposed mine is consistent with the historic mining uses in this area. <br />b) Upon completion and /or implementation of the required conditions, the proposal <br />will meet the standards of the Montrose County Zoning Resolution. <br />Conditions of Approval: <br />1. Prior to mining operations all applicable County, State and Federal permits shall be <br />obtained and maintained in good standing at all times for all mining operations. <br />Approved copies of all required permits shall be provided to the Planning and <br />Development Department. <br />2. The mine operator shall comply with a weed management agreement created by the <br />Montrose County Weed Management Department. <br />3. The development of the facility shall be in conformance with all material <br />representations included in the Special Use Permit Application submitted on or after <br />October 12, 2010. <br />4. All mining and hauling activities shall be subject to the Road Improvement <br />Agreement, New Horizon North Mine Special Use Permit, approved by the Montrose <br />County Board of County Commissioners. <br />5. Prior to operation of the coal mine the Planning and Development Department will <br />inspect the site to verify compliance with all approved plans, acceptance by all <br />appropriate County Departments and compliance with all conditions attached to the <br />permit. <br />6. Use of the 100 foot buffer zone adjacent to County road right -of -ways will be <br />permitted for surface activities which include: soil stockpiles, haul roads, <br />maintenance facilities, offices parking areas, storage areas and other similar mining <br />
