Bergstrom subject: Condition of Approval no. 3 to Amendment no. 3 to permit M-77-378 Condition of Approval no. 3 to the open pit mine permit (Amendment no. 3) states that an analysis of exploration drill core and acid drainage mitigative, plan for waste-rock are to be submitted to and approved by MLRD before "disposal" of waste-rock occurs. Disposal of waste-rock is, by the plan, in tWO permanent waste-rock piles numbered 1 and 2 on Exhibit C-1 of Amendment no. 3. These sites have the potential to create runoff which will drain off site and not pass through any current mine water treatment system. It was the interpretation of the Sunnyside Gold Environmental nepartment that thw Conditinn of Approval, as written, did not preclude the normal temporary stockpiling of waste-rook as a component of rock movement in and around the pit or for road or laydown area construction. The intent of the Condition was to preclude "disposal" of waste-rock in a permanent position until the acid drainage mitigative plan could be approved and implemented. To confirm this interpretation I phoned Ms. Camille Farrell at MLRD, Denver on June 20, 1968 at 3:29 p.m. to inform her that a temporary waste-rock pile was being placed around the area shown as a contractor laydown area on Exhibit C-1 of Amendment no. 3. She was informed the detailed engineering plane had shown that considerably less waste-rock was to be produced than was calculated in the Amendment no. 3 document. As such, it was desirable to retain waste-rock as Close to the Emma Stops as possible to facilitate future reclamation. In this way it might be possible to avoid disturbing the permanent stock pile areas entirely. we agreed over the phone that map representations of actual configurations would be submitted in the 1988 annual report to MLRD for the Sunnyside operation. Me. Farrell was informed that the core analyses and an acid drains. a mitigative plan would still be submitted before any rock wassposited at the permanent waste-rock disposal sites of ExhibitI Preliminary information to this effect was submitted to MLRD on July 12, 1988. My notes on this conversation are attached. No written correspondence was prepared by either party.
