File No. M- 77-378 <br /> Page 5 <br /> These three project work plans have been submitted to CDPBE as construction plans for <br /> certification under Sunnyside's Stormwater Permit COR- 040054, Mayflower Mill. Attached is <br /> CDPBE's letter amending the permit certification to include these projects. These projects will <br /> also be included under the Consent Decree as`B List" alternate projects although adequate <br /> approval for construction will have been obtained with DMG approval and the CDPBE <br /> Stormwater Permit approval (construction outside MLR boundary). <br /> RECLAMATION PLAN <br /> The approved reclamation plan will not change with this TR. No disturbances of land not <br /> previously disturbed within the permit area are required to implement the proposed work plans. <br /> Any areas disturbed by construction will be replanted according to the existing reclamation plan. <br /> All installations will remain upon final reclamation. <br /> BONDING <br /> All installations are to be left as permanent diversions upon final reclamation and no additional <br /> land within the MLR Permit boundary will be disturbed. Therefore, additional reclamation costs <br /> will not be incurred for final reclamation. <br /> Sunnyside believes the basic change to the MLR Permit proposed by the submittal of these <br /> projects (to the concepts and plans in the existing MLR permit) is the addition of a drainage outlet <br /> for the Tailings Pond No. 4 toe and embankment runoff collection pond. The remaining work <br /> could be considered maintenance type work to improve the efficiency of existing structures or <br /> fully implement concepts in the existing facility MLR permit. If this is accurate, please regard the <br /> submitted information on any work not requiring a TR submittal as a proposed maintenance work <br /> update and evaluate for those items you believe require a permit TR.
