Nelson: <br /> As discussed in our telephone conversation, the Colorado Division <br /> of Minerals and Geology (CDMG) requires a determination by the <br /> State Engineers Office whether a well permit is required to <br /> intercept subsurface flow as proposed in the attached Technical <br /> Revision submittal (see item 6 of attached CDMG letter) . <br /> The water that would be intercepted by this project currently <br /> enters the Sunnyside Mine through the Lake Emma hole (now <br /> backfilled) and exits the Terry Tunnel to Eureka Creek. Before the <br /> hole existed (pre-June 1978) the water targeted for <br /> interception/diversion most likely fed Lake Emma and exited as lake <br /> overflow at approximately the same point that is proposed for <br /> release of the intercepted waters. This water then would flow <br /> overland to Eureka Creek (about 1 mile above the Terry Tunnel) or <br /> back to subsurface flow, the same choice that existed prior to Lake <br /> Emma collapse.
