STATE OF COLORADO
DIVISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources
1313 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866 -3567
FAX: (303) 832 -8106
August 22, 2012
Tom Bird
GCC Energy, LLC
6473 County Road 120
Hesperus, CO 81326 -9633
Re: King Coal Mine (Permit No. C- 1981 -035)
Technical Revision No. 20 (TR -20)
Use of Coal Mine Waste for Backfilling King I Portal Highwall
Dear Mr. Bird:
COLORADO
D I V I S I ON OF
RECLAMATION
MINING
SAFETY
John W. Hickenlooper
Governor
Mike King
Executive Director
Loretta E. Pineda
Director
We have received your application for a technical revision to your permit to conduct coal mining in
Colorado. Our initial review indicates that all preliminary items required by Rule 2.08.4(5) have
not been submitted. Thus, your application is incomplete for the purposes of filing as of August
22, 2012.
Some portions of the proposed Public Notice refer to the King I Mine, whereas the quadrangles
referenced are applicable to the King Coal Mine as a whole (including King 11). Please revise the
text to clarify the difference between the King Coal Mine and the King I Mine to which this
revision applies.
A report prepared by Trautner Geotech has been submitted, and provides various options for
replacement of the coal mine waste as backfill against the King I portal highwall. The TR -20
application does not contain a description of the final configuration (particularly the H:V slope and
volume of the backfilled material) that GCCE proposes to construct. These details would be
appropriately provided in the Backfilling and Grading portion of Section 2.05.4. In addition, the
proposed configuration should be illustrated and identified on a permit map.
In accordance with Rule 2.07.3(1), you have the opportunity to amend, review, or otherwise make
your application complete.
If you have any questions, please contact me.
Sincerely,
Marcia L. Talvitie, P.E.
Environmental Protection Specialist
cc: Sandy Brown, DRMS
Office of Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
