Box 177 <br /> Silverton, CO 81433 <br /> Re: Disposal of Settling Pond Material at Sunnyside Gold Mine Terry Tunnel Facility <br /> Dear Mr. Bergstrom: (1�4- 77-,3 7SO <br /> I have discussed with the staff the issue you raised regarding the material <br /> disposed on the bench near the Terry Tunnel Facility. It is apparent that there is <br /> a concern that the quality of the material is such that it could have an adverse <br /> effect upon water quality and the achievement of final reclamation. We need to <br /> examine this further. As such, I propose to proceed in the following manner. <br /> For now, I will presume that Sunnyside Gold Corporation does not intend to remove <br /> the material , and therefore does not intend to modify the amendment to the plan <br /> requesting the material remain in place. <br /> We will conduct further analysis of the nature of the material and assess the <br /> potential impacts of leaving the material in its present location. When we have <br /> concluded our analysis and assessment, we will inform you whether in our juoament <br /> the material could remain in place if properly managed, or if it shouid be moved to <br /> the tailings disposal area. If you concur with our assessment, then I presume we <br /> should be able to work out an appropriate plan for either in-place management or <br /> removal to the tailings area. If we disagree after the Division's assessment, then <br /> we will need to bring the issue to the Mined Land Reclamation Board for final <br /> determination. The procedural mechanism to do so would be the enforcement <br /> process. Our schedule is to complete the assessment in May, 1988 so that, if <br /> necessary, the issue would be presented to the Board in dune. <br /> I appreciate your bringing this matter to my attention, and look forward to your <br /> cooperation in resolving the issues.
