As proposed in my <br /> letter to Frank Bergstrom, dated May 9, 1988, additional analysis of the Terry <br /> Tunnel pond sediment has been conducted. The analytical results indicate that <br /> the material has the potential to adversely affect water quality of Eureka <br /> Creek and possesses phytoxic concentration of metals which are likely to <br /> inhibit the achievement of final reclamation. Copies of the Division's March <br /> 9, 1988 and June 21 , 1988 analyses of the Terry Tunnel sediment are enclosed <br /> for your review. <br /> Upon review of the analytical results, the Division has determined that the <br /> Terry Tunnel pond sediment, currently disposed in a trench adjacent to the <br /> Terry Tunnel Ponds, requires removal to the approved sewage disposal site, <br /> atop Tailing Pond No. 3, or another location approved by the Mined land <br /> Reclamation Board or Division. If you agree with our assessment, please <br /> provide a plan, complete with schedule, for disposal of the material ; the <br /> removal should be completed during the 1988 field season. If you disagree <br /> with our assessment, the matter will be presented to the Mined Land <br /> Reclamation Board at their August 24-25, 1988 meeting for final <br /> determination. The procedural mechanism to do so would be the enforcement <br /> process.
