Michelle Hatcher Page 3 <br />August 20, 2012 <br />Conditions of Approval <br />I hereby approve the proposed SWSP in accordance with § 37 -90- 137(11), C.R.S., subject <br />to the following conditions: <br />1. This SWSP is approved with the effective date of May 1, 2012 and shall be valid through <br />April 30, 2013, unless otherwise revoked, modified or superceded by decree. This plan will <br />be extended until April 30, 2014 if the Applicant provides a copy of the lease <br />agreement with the LAWCD by April 30, 2013 for the fully consumable replacement <br />water to replace depletions from the operation of this gravel pit site for the period of <br />May 1, 2013 through April 30, 2014. The Applicant shall provide a copy of the lease to the <br />SEO, division engineer, and water commissioner. If a lease is not provided by April 30, <br />2013, this plan shall expire on that date and all use of water under this SWSP must <br />cease immediately. <br />2. If this plan will not be made absolute by a water court action by the plan's expiration date, a <br />renewal request must be submitted to this office with the statutory fee (currently $257) no <br />later than March 15, 2013 or March 15, 2014 subject to the requirement of condition 1 <br />above. <br />3. Applicant must provide the name, address and phone number of the person who will be <br />responsible for the operation of the plan to this office, the division engineer, and the water <br />commissioner within 20 days of the receipt of this approval. <br />4. Well Permit No. 75864 -F, has been obtained for the current uses (including dewatering) <br />and exposed pond surface area of the gravel pit in accordance with §37 -90- 137(2) and <br />(11), C.R.S. <br />5. The total surface area of the groundwater exposed at the West Farm Pit after December <br />31, 1980 must not exceed 0.5 acres resulting in 2.5 acre -feet of evaporative loss. <br />6. The total amount of product mined at the West Farm Pit shall not exceed 750,000 tons per <br />year, which results in 22.1 acre -feet of water lost with product, and 6.2 acre -feet of water <br />used for dust control. <br />7. Total consumption at the pit(s) must not exceed these aforementioned amounts unless an <br />amendment is made to this SWSP. <br />8. Approval of this SWSP is for the purposes as stated herein. Any additional uses for which <br />the water may be used must first be approved by this office. Any future additional historical <br />consumptive use credit given (e.g. agricultural water transfer) for this site must consider all <br />previous credits given. <br />9. Documentation of the pond size may be required by the Division Engineer in the form of an <br />aerial photo evaluation or survey by a Professional Land Surveyor during the plan year of in <br />subsequent years covered by the renewal of this plan. Any increases in depletions must be <br />submitted to this office as an amendment to this plan. Water delivered to the Arkansas <br />River from the dewatering trenches and settling pond may not be commingled with <br />irrigation supplies being delivered to the remaining portions of the farm and must be <br />delivered in a manner that ensures that no additional surface evaporation occurs beyond <br />
