<br />CORRECTION SPECIAL WARRANTY DEED
<br />THIS DEED, Made this 8 th day of November, 1995, between San Miguel Powor Association, Inc.,
<br />grantor, and Western Fuels—Colorado, Y.L.C. whose legal address is 12076 Grant St., Thorton, CO 80241, grantee:
<br />WI'iINESSETH, That the grantor, for and in consideration of the receipt of the sum of $48,350.00, the
<br />receipt and sufficiency of which is hereby acknowledged, has granted, bargained, sold and conveyed, and by these
<br />presents does grant, bargain, soil, convey and confirm, unto the grantee, its successors and assigns forever, all the
<br />real property together with improvements, if any, situate, lying and being in the County of Montrose and State of
<br />Colorado described as follows: The E1 /2 of the SW1 /4 of Section 25, Township 47 North, Range 16 West,
<br />N.M.P.M., consisting of 80 acres, more or less, together with all interest of Seller in all easements and
<br />appurtenances thereto, ail improvements thereon and all attached fixtures thereon, except easements, restrictions,
<br />reservations and rights of way of record and taxes and assessments for 1995. '
<br />TOGETP..ER with all and singular the hereditaments and appurtenances thereto belonging, or in enywice
<br />appertaining, and the reversion and reversions, remainder and remainders, rents, issues and profits thereof and all
<br />the estate, right, title, interest, claim and demand whatsoever ofthe grantors, either in law or equity, of in and to
<br />the above bargained premises, with the heredttaments and appurtenances.
<br />TO HAVE AND TO II07.LU the said premises above bargained and described, with the appurtenances,
<br />unto the grantee, its successors and assigns forever. And the grantor, for itself, does covenant, grant, bargain, and
<br />agree to and with the grantee, its successors and assigns, that they shall and will WARRANT AND FOREVER
<br />DEFEND the above•roforenecd premises in the quiet and peaceable possession of the grantee, its successors and
<br />assigns, against all and every person or persons claiming the whole or any part thereof, by, through or under the
<br />grantor,
<br />THIS DEED OF CORRECTION is made in place of and as a Deed of Correction of a Deed executed by
<br />grantor to grantee dated September 25, 1995, and recorded on October 12, 1995 at Book 907, Page 35 in the Deed
<br />Records of Montrose County, Colorado, wherein by mistake the real property was identified as situate in Ouray
<br />County when in truth and fact the real property is situate in Montrose County. This instrument is made by mentor
<br />and accepted by grantee in order to correct said mistake, and in all other respects confirms said former Deed,
<br />IN WITNESS WHEREOF, the grantor has executed this deed on the date sot forth above, but to be
<br />effective on the 25th day of September, 1995.
