the potentially affected area associated with New Horizon North Mine. <br />WFC is unaware of the availability of any information which indicates that any <br />portion of the New Horizon North Mine property has been or is under consideration <br />or study for designation as land unsuitable for mining <br />2.03.7(2) Legal and Financial Commitments. N /A. <br />2.03.7(3) Ownership Waivers. No mining activities are proposed to occur within 300 feet <br />of an occupied dwelling. No waiver is required. <br />2.03.8 Permit Term Information <br />WFC expects to start the mine development activities in the New Horizon North <br />Mine in 2012. The mine is expected to start mining coal in mid 2013. The coal <br />mining is expected to terminate by the end of 2018. The total area within the mine <br />permit will be 322 acres. <br />2.03.9 Personal Injury and Property Damage Insurance Information <br />This information is included as Appendix 2.03.9 -1. <br />2.03.10 Identification of Other Licenses and Permit Pertinent to Surface Coal Mining <br />Federal <br />Mine Safety and Health Administration (MSHA) <br />Mine I.D. Number — 05 -00299 from MSHA District #9 <br />U.S. Army Corps of Engineers (USACOE) <br />WFC is applying for USACOE 404 permit to cross the Tuttle Draw for equipment <br />crossing and for disturbing wetlands in the mining area. It will be submitted to <br />DRMS when received. Equipment crossing or mining activity will not begin until <br />this permit is in place. <br />Federal Communications Commission (FCC) <br />New Horizon Mine has commercial radios and has been assigned a frequency of <br />151.775 MHz by the FCC. New Horizon Mine was also issued a call sign of <br />WPGP927 by the FCC.
