Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />The Division received the 2011 Annual Reclamation Report (TR109) on March 15, 2011. The <br />application was called complete for review on April 6, 2012 and the decision date for the revision is <br />August 31, 2012. There is one issue that will need to be addressed prior to the Division's approval of <br />TR109. <br />Annual Reclamation Report Form: <br />A discrepancy was noted during the first adequacy review in regards to the Phase I, II and III bond <br />release acreage reported in the 2011 annual reclamation report. Trapper responded to this concern citing <br />several errors /irregularities noted from previous bond release applications. Also included with the <br />response is a detailed accounting of the parcels that have been re- disturbed that have been granted Phase <br />I, II and III bond release in the past. <br />The first item cited was a typographic error in the SL6 Proposed Decision and Findings Document. The <br />findings document included a summary of the bond release histories and reported an incorrect acreage <br />amount for the SL6 approval. Trapper should have been approved for 819.6 acres for Phase II bond <br />release not 819.1. The Divisions records have been updated with the correct acreage for this bond <br />release. <br />The second item is in regards to a parcel A -B -98. This parcel was granted Phase I bond release during <br />SL5 for 50.7 acres. This parcel was also part of the SL6 Phase II bond release application. According <br />to your response letter, a portion of the parcel was removed from the SL6 release due projected re- <br />disturbance reducing the Phase II release acreage to 40.5 acres. However; according to the Divisions <br />files, the parcel was reduced by 10.3 acres in a letter dated February 17, 2005. This should have reduced <br />the acreage to 40.4 acres for this parcel. Also, according to the SL10 application parcel A -B -98 was <br />45.9 acres in size not 45.7 as indicated in the response letter. Given this, 5.5 acres of parcel A -B -98 <br />received Phase III bond release but not Phase II (45.9 acres minus 40.4 acres). <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines <br />
